Mission

The Law Offices of Jane Oak strives to be a reputable source of legal counsel and services in immigration law so that our clients can make wise decisions and achieve their personal goals in the United States.

Jane Oak began her legal career handling large commercial real estate transactions as an Associate Attorney at Pircher, Nichols & Meeks in Century City, California. Her passion for helping people, namely the disadvantaged immigrant community, pulled her away from the corporate world and into her own practice in 2000. With her determination and heart, the firm has grown into one of the largest and most reputable immigration practices.  

Unlike most other immigration law offices, we specialize solely in immigration law and scope of our services start from your entry into the U.S. as a non-immigrant, becoming a permanent resident and then a U.S. citizen, and petitioning for any family members. However, because our services and expertise also include removal defense, we can provide high-level legal counsel and strategy that is holistic and, in our clients’ best interest.  

Immigration Services

Marriage-Based

If you are an immediate relative of a U.S. citizen, you can become a lawful permanent resident (get a Green Card) based on your family relationship if you meet certain eligibility requirements.

Immediate relatives are:

  • The spouse of a U.S. citizen;
  • The unmarried child under 21 years of age of a U.S. citizen; or
  • The parent of a U.S. citizen (if the U.S. citizen is 21 years of age or older).

Parent/Child Petitions

To petition to bring your sibling (brother or sister) to live in the United States as a Green Card holder, you must be a U.S. citizen and at least 21 years of age. Permanent residents may not petition to bring siblings to live permanently in the United States.

To petition to bring your sibling (brother or sister) to live in the United States as a Green Card holder, you must be a U.S. citizen and at least 21 years of age. Permanent residents may not petition to bring siblings to live permanently in the United States. 

Adoptions

Immigration through adoption, or intercountry adoption, refers to the adoption of a child born in one country by an adoptive parent living in another country.

United States immigration law provides three different processes through which someone may immigrate on the basis of an intercountry adoption. An individual may immigrate under one of these provisions only if the individual’s adoption meets all the requirements of that specific process.

Two separate processes apply only to children adopted by U.S. citizens. The child may immigrate immediately after the adoption or may immigrate to the U.S. to be adopted here.

The Hague Process: if the child habitually resides in a country that is a party to the Hague Intercountry Adoption Convention.

The Orphan Process: (non-Hague): if the Hague Intercountry Adoption Convention does not apply.

Many aspects of the Hague and Orphan requirements are similar.

In the third process, a U.S. citizen or permanent resident may petition for his or her adoptive child through an Immediate Relative Petition.

VAWA Claims

Under the federal Violence Against Women Act (VAWA), you may be eligible to become a lawful permanent resident (get a Green Card) if you are the victim of battery or extreme cruelty committed by:

  • A U.S. citizen spouse or former spouse;
  • A U.S. citizen parent;
  • A U.S. citizen son or daughter;
  • A lawful permanent resident (LPR) spouse or former spouse; or
  • An LPR parent.
