Cedric M. Shen, Esq. Immigration Attorney
Cedric M. Shen is a U.S. immigration attorney who has been practicing law more than 15 years. Born and raised in Vancouver, Canada and currently headquartered in Los Angeles, Mr. Shen is a proud dual Canadian & U.S. citizen. He has also been through the U.S. immigration process firsthand – as an F-1 student, to TN visa, to H-1B visa, to EB-2 green card and finally naturalizing as a U.S. Citizen. Mr. Shen is licensed to practice law in the State of California, the State of Washington, and in all United States Immigration Courts. He is also licensed to practice U.S. law in the province of British Columbia as a Practitioner of Foreign Law. Mr. Shen has been interviewed by major news media outlets, such as Fox News, National Post, The Globe and Mail, and CNN Money. He has also been invited to speak on the topic of immigration law by numerous organizations across North America, including the Canadian Consulate General, State Bar of California, California Employers Association, the University of British Columbia, and the Asian Real Estate Association of America – to name a few. He has also published several legal articles – including two published articles before graduating from law school. Fiancé Visa Green Card
The K-1 visa allows a foreign national who is engaged to a U.S. citizen to enter the United States in order to get married and apply for a green card. This includes same sex & LGBTQ fiancés. The foreign spouse may bring his/her dependents/children under K-2 visas.
K-1 Fiancé Visa Requirements
- The petitioner must be a U.S. citizen
- The couple must intend to marry within 90 days of the fiancé(e) entering the United States
- The couple must be free to marry one another (i.e., if previously married, the party must provide proof of a divorce or death certificate)
- The couple must have met each other at least once in the two years preceding the application (unless doing so would violate a cultural/social practice or result in extreme hardship)
K-1 Fiancé Visa Procedure
The U.S. citizen spouse must first file a K-1 application. Once approved, the fiancé will apply for the K-1 visa at the U.S. consulate abroad. Upon approval, the fiancé enters the United States and marries the U.S. spouse within ninety days. Once married, the foreign spouse can adjust her status to a U.S. permanent resident. The fiancé is also eligible to apply for employment authorization immediately upon entry into the U.S.
K-2 Visa for Dependents
Unmarried children under 21 of the foreign fiancé are eligible to enter the United States as K-2 dependents of the K-1 fiancé.
